1. Acceptance of Terms

By accessing and using SmartStudy ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. User Accounts and Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Use only one account; multiple accounts are prohibited

3. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate or infringe upon the rights of others, including intellectual property rights
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Attempt to reverse engineer, decompile, or disassemble any portion of the Service

• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit viruses, malware, or any other harmful code

4. Subscription Terms and Payment

The Service offers a subscription plan at ₦6,000 NGN per year. Subscription grants access to 5 WAEC subjects and 3 JAMB subject combinations as described in the Service.

• Subscription fees are billed annually in advance
• All fees are non-refundable except as required by law or as stated in our refund policy
• Subscription automatically renews yearly unless cancelled before the renewal date
• You can cancel your subscription at any time from your account settings
• You are responsible for providing valid payment information
• We reserve the right to change subscription prices with 30 days notice
• Failure to pay may result in suspension or termination of your account

5. Refund Policy

All subscription fees are non-refundable unless required by applicable law. If you cancel your subscription, you will continue to have access to premium features until the end of your current billing period. Refunds, if any, will be processed at our sole discretion.

6. Intellectual Property Rights

All content on the Service, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of SmartStudy or its content suppliers and protected by copyright and other intellectual property laws. You may not:

• Reproduce, distribute, modify, or create derivative works from our content
• Use our trademarks or service marks without our prior written consent
• Remove any copyright or proprietary notices from our content

You retain ownership of any content you submit, but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content for the purpose of providing the Service.

7. AI-Powered Features

The Service uses artificial intelligence to provide personalized explanations and recommendations. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You acknowledge that AI explanations are provided "as is" and should not be solely relied upon for academic or professional purposes. We are not responsible for any consequences arising from reliance on AI-generated content.

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SmartStudy, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Curriculum and Educational Content

The Service provides content aligned with WAEC, NECO, and JAMB curricula. While we strive to ensure accuracy and alignment, we do not guarantee that our content is complete, current, or officially endorsed by these examination bodies. Users should consult official curriculum documents and examination guidelines for authoritative information.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination:

• Your right to use the Service will immediately cease
• You remain liable for all amounts due up to the date of termination
• We may delete your account and data in accordance with our Privacy Policy

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Nigeria.
